1. Terms and Conditions
This license grants you, the purchaser, a non-exclusive, non-transferable, non-sub-licensable, worldwide, in perpetuity, license to reproduce, modify, adapt and make use of the music in synchronization with other audio and/or audio-visual productions, in unlimited projects, in the following ways:
Personal projects, wedding videos, school, college or university projects and videos and student films.
In online streaming (YouTube and Vimeo videos with monetization).
Personal, professional and commercial websites, blogs and social media.
Podcasts, slideshows, private presentations and Powerpoints.
Corporate and commercial videos, product presentations and online talk shows.
Online advertisements: web promos, web advertising, logos, idents and other advertising.
Music-on-hold system for telephones or answering machines for SMEs and large corporations.
FM radio stations (cable, satellite, radio transmission), in public places, at points of sale, at festivals, at professional trade fairs, at conferences (unlimited audience).
Cinema, regional & national TV broadcasts, TV adverts and motion pictures regardless of the method of broadcasting - including cable, satellite, IP TV (unlimited audience), as well as on any type of free or subscription-based video on demand service and pay-per-view TV channels.
Talk shows, series and sitcoms, shorts, documentaries and trailers.
Performing arts: theatre plays, dance exhibitions, fireworks, dance classes, shows and public events.
Apps, software applications, mobile application, DVDs and PC/console video games (unlimited number of physical/digital copies).
2. Limitations of Use
You are not authorised to:
a) Sell, transfer, sublicense or otherwise assign the music to any other party.
b) Resell the music by itself or as part of a package except solely as embodied within your project.
c) Any direct use of the music, particularly making the music available through direct download or as part of a compilation.
d) Claim to be the creator or copyright holder of the music.
e) Any use of the music in a way that is fraudulent, illegal, defamatory, offensive, discriminatory or in a manner that promotes, solicits or encourages the infringement of intellectual property rights.
f) Using our music to create your own music, song or remix.
3. Ownership
You hereby acknowledge that FiftySounds is and remains the owner of all rights. This license is non-exclusive and FiftySounds retains the right to sell licenses of the music to third parties at its sole discretion.
4. Performing rights
The music is royalty-free audio. This means it is not registered with any P.R.O, but FiftySounds cannot guarantee you will not be required to pay performing rights fees or any other similar fees to local performing rights organizations or similar collecting societies under specific local statutes or legislation.
5. Limitation of Liability
FiftySounds accepts no responsibility for any loss of business, loss of opportunity or business profits resulting directly or indirectly from the performance of the music. The total liability of FiftySounds under this agreement arising from your use of the music shall be limited to the license fee paid by you for such music. Furthermore, FiftySounds shall not be liable for any cost, claim, damage or loss resulting from a modification made to the music by you or the context in which the music is used.
6. Reservation of Rights
All rights which are not expressly granted by FiftySounds to you pursuant to this agreement are specifically reserved by FiftySounds.
