The following is a legal agreement between you and the owners of the site at fiftysounds.com (FiftySounds).
We reserve the right, at our sole discretion, to change or modify portions of these Terms at any time.
You may use FiftySounds only in compliance with these Terms and all applicable laws, rules, and regulations. Any rights not expressly granted herein are reserved by FiftySounds.
License for Content – FiftySounds License
Content on FiftySounds is made available to you on the following terms. Under the FiftySounds License you are granted an irrevocable, worldwide, non-exclusive and royalty free right to use, download, copy, modify or adapt the music for commercial or non-commercial purposes, in synchronization with other audio and/or audio-visual productions.
Attribution is required. You must credit our music tracks by placing a link to https://www.fiftysounds.com on your video, website, or wherever the music is used.
How to attribute:
For websites: insert the attribution on the page where the track is to be played.
For videos: the attribution must appear in the description field.
For radio and television: please, include the link in your main website.
Attribution is optional for sound effects.
The FiftySounds License does not allow:
a. Selling, reselling, sublicensing or distributing FiftySounds’ music.
b. Compiling music from FiftySounds to replicate a similar or competing service. You must not use the music to build a service or product that is similar or competitive with FiftySounds. You can't aggregate or collate the music and make available on a stock or inventory basis.
c. Using the music for illegal purposes. You must not use the music in the context of adult content, supply of weapons or gambling services, exploitation of children, hate speech, defamatory content, misleading or deceptive conduct, or any illegal activity.
d. Claiming to be the creator or copyright holder of the music.
e. Using our music to create your own music, song or remix.
Indemnification for breach of Terms
You agree to indemnify and hold harmless FiftySounds from and against any and all loss, expenses, damages, and costs, including without limitation reasonable attorneys fees, resulting, whether directly or indirectly, from your violation of the Terms. You also agree to indemnify and hold harmless FiftySounds from and against any and all claims brought by third parties arising out of your use of the Website.
Warranty and liability
The website and its content are provided "as is". We offer no warranty, explicit or implied, regarding any content, the website, the accuracy of any information, or any rights or licenses under this agreement including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. FiftySounds does not represent or warrant that the website or its content will meet your requirements or that their use will be uninterrupted or error free. FiftySounds shall not be liable to you or to any other person or entity for any general, punitive, special, indirect, consequential or incidental damages, or lost profits or any other damages, costs or losses arising out of your use of the website or its content.
As we continue to develop and improve the FiftySounds service, we may amend these terms or even cease providing the service at any time. In addition to any other legal rights we have, we can terminate your license rights (and require that you cease all use of the music) if you breach the FiftySounds License or Terms and Conditions.
The laws of Madrid, Spain govern these terms, and you submit to the jurisdiction of the courts there for the resolution of any dispute between us.
